Based on recent legal developments to ensure a smooth and secure experience in the United States, it’s essential for all non-citizens to maintain proof of valid legal status at all times, such as a green card or nonimmigrant visa status such as an L-1, H-1B, E-3, TN O-1, or OPT. Additionally, it’s crucial to carry proof of your valid legal immigration status with you, as this serves as evidence of your legal entry and status in the United States.
For those who have obtained an extension or change of status, it’s also important to keep a copy of your most recent I-797 form, which is the notice of action from the US Citizenship and Immigration Services. This form provides evidence of your updated immigration status.
If you have a green card and you’re a Lawful Permanent Resident, you’re required to keep your physical Green Card (I-551 Card) on you at all times.
Essential Documents for Non-Green Card Holders
If you don’t yet have a green card, we recommend that you carry the following documents with you at all times:
- Photo ID
- Photocopies of:
- Passport biographic page
- Valid visa
- Most recent I-94
- Most recent I-797 form (this often contains your most recent I-94)
- Pro tip: you can fit all of these photocopies on the front and back of a single sheet of paper. You can also keep them readily available on your cell phone but we recommend having a physical copy, not just digital.
